My friend has asked me to give her a false employment reference. Is it illegal?

My friend has applied for a job and asked me to give her a reference even though she's never worked for me and I know they will check up.My friend has asked me to give her a false employment reference. Is it illegal?
Could be classed as fraud or a number of other things.


Pretty stupid really.

Illegal? No. Immoral? Yes!





Why doesn't your friend have one good reference that she can give to this company? Is she that big of a loser that she hasn't got one former employer who has something nice to say?





If it's just that she's never held a job, that's understandable. You have to start somewhere. However, if she has had jobs, but no one is willing to give her a reference, that's a sign that something is horribly wrong.





She can use you as a personal reference, but saying she worked for you is WRONG!

If they contact you, you need to say that she hasn't worked for you but you can offer a character reference, and perhaps she got a bit confused about the type of reference needed. That will get you off the hook. You aren't refusing a reference, but are offering a character ref, which might be acceptable.
I doubt that you will be held legally liable for giving a false reference, unless the company can prove somehow that financial damage was caused by hiring this person and that your reference somehow creates liability for that damage (this seems like a stretch to me, but then I've heard of courts supporting wilder theories, so you never know).





Whether there is a legal liability or not, certainly it is unethical to provide a false reference. I would not do it.
I don't know whether you will be legally liable if it comes to light, but I seem to remember a similar case in which somebody was convicted of 'obtaining pecuniary advantage by deception' for obtaining a false reference. If you're a genuine friend, you should advise your friend not to do this. Give a personal reference, not a wor one. Why is she unable to get a reference from her former employers?
You mustn't think about pretending that your friend ever worked for you. It might, if things reached their ultimate conclusion, amount to conspiracy to obtain pecuniary advantage by deception (although you'd get nothing out of it).





What you can do is give your friend a personal reference. If she hasn't had any jobs so far, this is all she can reasonably be expected to produce for a prospective employer. We all start like that!
Yes this is completely illegal. This is just like filling out an application and putting in someone else's address and Name just to get the job. If you put this in and they contact you, it's a crime that can be punishable by jail time if the employer seeks that to be necessary.
Your allowed to give friends as references. If she's told them your just a friend then thats ok. If she's told them she used to work for you then it's not.


She just needs a character reference, its perfectly fine.You just state how long you've known her and the type of person she is.
Its not really illegal, if the company finds out, they just won't employ your friend because its obvious she's not trustworthy or honest =)





Edit* It COULD be illegal if its for something like; teacher, nurse etc. Usually, its just dishonest, NOT illegal.
Yes it is illegal in UK she commits an offence of obtaining a pecuniary advantage and you aid and abet the offence which comes under the Theft Act and carries fine and/or imprisonment.
not illegal, but just not 'right' avoid the employer reference and go witha great character reference, which is the next best thing and wont rock your friendship
NO, in fact it is standard practice. It's a great way of getting jobs that would normally be out of reach. Why not try adding a fake degree. Sure to increase the salary offer by at least a couple of thousand.
You can offer to give her a character reference instead of an employment reference. It would mean neither of you are lying
It's a matter of principle and morals. If you can put your head on the pillow at night after you commit fraud. My advice would be to refuse this as it would go against your principles. If shes a true friend she'll understand.
yes, this is illigal, this is pathetic and stupid for her to ask you to do that! it wont only be her going in prisonment. it will be you also! dont do it.
Long stretch to fraud; just really unethical and odds are probably going to be caught. Just tell the truth, give a personal reference and avoid the fake employer idea.

It is unlikely to get you a jail term, but it could damage her credibility and yours.
